We at Game & Give, LLC d/b/a RFFL (“RFFL”) know you care about how your personal information is used and shared, and we take your privacy seriously.  Please read the following to learn more about our Privacy Policy.  By using or accessing our website, any of our services, or applications (the “Services”) in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, as may be amended from time to time, and you hereby consent that we will collect, use, and share your information in the following ways.

Remember that your use of RFFL’s Services is at all times subject to the Terms of Service, which incorporates this Privacy Policy.  Any terms we use in this Privacy Policy without defining them have the definitions given to them in the Terms of Service.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we may gather when you are accessing or using our Services.  However, this Privacy Policy does not cover the practices of companies we do not own, or control or people that we do not manage.  This Privacy Policy also does not cover information we receive from other sources, publicly available information, or information received from other indirect or unintentional disclosures.

We gather various types of Personal Information from our users, as explained in more detail below.  This Personal Information is used internally in connection with our Services, including, without limitation, our actions taken to personalize, provide, and improve our Services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, if applicable, through the Services, to fulfill your requests for services, and to analyze how you use the Services.  In certain cases, we may also share some Personal Information with third parties, as described below.

As noted in the Terms of Service, in order to use RFFL’s Services, you must be at least eighteen (18) years old.  The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under thirteen (13).  For the avoidance of doubt, regardless of parental consent, no one under the age of eighteen (18) years old shall be eligible to access or use our Services, and accordingly, RFFL never knowingly or intentionally collects Personal Information from anyone under the age of eighteen (18).  If we learn that we have collected Personal Information from anyone under the age of eighteen (18), we will endeavor to delete that information as quickly as possible.  If you believe that a child under eighteen (18) has provided us with personal information, please contact us at support@rffl.co.  We urge parents to instruct their children to never give out their real names, addresses, phone numbers, or other personal information, when they are online.

As outlined in the Section 2 of the Terms of Service, in order to prove eligibility to participate in any event, certain information must be provided and confirmed.  As part of proving eligibility, RFFL will compare such provided information against information contained within the “Self-Exclusion List” (as defined in the Terms of Service) provided by any of the Authorized Organizations (as defined in the Terms of Service) related to any Campaign (as defined in the Terms of Service).  The information which is contained within the Self-Exclusion List, may contain the same, similar, or additional information than what is provided as part of proving eligible, however, this information is not subject to this Privacy Policy, and is only provided by the Authorized Organization to RFFL for the purposes of flagging potential conflicts.  Upon raising such potential conflicts with the Authorized Organization, RFFL has no further involvement in the process of determining eligibility, and such determination is left solely the determination of the Authorized Organization.

Will RFFL ever change this Privacy Policy?

We are constantly trying to improve our Services, so we may change this Privacy Policy from time to time.  We reserve the right to change the Privacy Policy at any time, but if we do, we will alert you to changes by either (or a combination of) placing a notice within the Services, on the website, or sending you an email if you have provided us with such contact information.  Please note that if you have opted not to receive legal notice emails from us (or you have not provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them.

If you do not agree with the new Privacy Policy, you may reject them.  However, if the terms are rejected, you will no longer be able to use the Services.  If you use or access the Services in any way after a change to the Privacy Policy (or Terms of Service) is made effective, such usage shall be deemed agreement with all of the changes.

What information does RFFL Collect?

Information You Provide to Us:

We may receive and store any information you knowingly provide to us.  For example, through the registration process and/or through your account settings, we may collect Personal Information such as your name, address, last four (4) digits of your social security number, email address, and phone number.  

You authorize us to communicate with you if you have provided us the means to do so.  For example, we may contact you via any method viable via this information, i.e., physical mailing, emails, and calls/texts, and you further authorize that we may communicate to you via other “push notifications” via RFFL Services.  We may send you promotional email offers on behalf of other businesses, or email you about your use of the Services.  Also, we may receive a confirmation when you open an email from us.  This confirmation helps us track engagement, which allows us make our communications with you more interesting and improve our Services.  If you do not want to receive communications from us, please indicate your preference by contacting us at support@rffl.co.

Information Collected Automatically:

Whenever you interact with our Services, we (or one of our partners) automatically receive and record information on our server logs from your browser or device, which may include your IP address, device identification, “cookie” or “pixel” information, the type of browser and/or device you are using to access our Services, your operating system, screen resolution, and how you may use, or interact with, our Services, and the page or feature you requested.

“Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. “Pixels” or “web beacons” are defined below. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, or to opt-out of some automatic data collection features, but this may prevent you from taking advantage of some of the features of the Services.

Our advertising partners may also transmit cookies, pixels, beacons or other similar tools to your browser or device, or when you click on ads that appear on or within the Services. Also, if you click on a link to a third -party website or service, a third party may also transmit cookies, beacons, pixels or similar tools to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we are not responsible for their privacy policies and practices.  Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

We may use this data to customize content for you based on your usage patterns. We may also use it to improve the Services – for example, this data can tell us how often users use a particular feature of the Services – and we can use that knowledge to make the Services interesting to as many users as possible.

Will RFFL share any of the Personal Information it receives?

We neither rent nor sell your Personal Information in personally identifiable form to anyone.  However, we may share your Personal Information with the types of third parties as described in this section or elsewhere in this Privacy Policy.

Agents:  We employ other companies and people to perform tasks on our behalf related to the Services, and we need to share your information with them to provide the Services.  For example, we may use a payment processing company to receive and process your credit card transactions for us.

Business  Transfers: We may choose to buy or sell assets.  In these types of transactions, customer information is typically one of the business assets that would be transferred.  Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of RFFL and Others:  We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of RFFL, our employees, our users, or others.

Is Personal Information about me secure?

Access to your account is restricted, requiring a password for your privacy and security.  You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately, and in accordance with site requirements, and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, including the use of standard HTTPS encryption protocols and other commercially reasonable measures. Unfortunately, we cannot guarantee complete security.  Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

What Personal Information can I access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you have provided to us:

  • First and last name

  • email address

  • phone number

  • username

  • password

  • other user profile information and certain content.

The information you can view, update, and delete may change as the Services change.  If you have any questions about viewing or updating information we have on file about you, please contact us at support@rffl.co.

Certain users may, depending on your location, have additional rights regarding your Personal Information (e.g. users in California and the European Union (EU)).  Some users have the right to view, amend, or delete the Personal Information that we hold about you, or ask us for a notice identifying the categories of Personal Information that we share with our affiliates and/or third parties for marketing purposes, or request the deletion of any email we hold on you at any time.  If this applies to you, you should be aware that requesting deletion, unlike unsubscribing from specific emails, is total and irreversible.  If you believe you are a user in one of these locations and have any questions relating to your Personal Information, please submit a written request to support@rffl.co.

What choices do I have?

You can always opt not to disclose information to us, but keep in mind some information or all of the requested information may be needed to register with us or to take advantage of some of our features.

You may be able to add, update, or delete information as explained above.  When you update information, however, we may maintain a copy of the unrevised information in our records.  You may deactivate your account through the account settings features, however we may retain certain information as permitted under the Terms of Service.  Some information may remain in our records after your deletion of such information from your account, unless you are a user in a location which requires permanent deletion of that Personal Information. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
